Od 2003. godine u našem radu važnom držimo temu ljudskih prava stranaca, osobito tražitelja/ica azila i nezakonitih migranata/ica. Od 1997. godine broj tražitelja/ica azila u Hrvatskoj raste i dosegao je brojku od više od 3000. Osim 500-tinjak tražitelja/ica azila koji/e redovito borave u Hrvatskoj, u Prihvatilištima za tražitelje/ice azila u Kutini i Zagrebu, u Republici Hrvatskoj živi i 65 osoba kojima je odobren status azila ili supsidijarne zaštite. Azilanti/ice porijeklom su iz uglavnom dalekih jugo-istočnih zemalja, iz različitih kulturnih i političkih pozadina.

Azil je pravna i politička zaštita koja se dodjeljuje onim izbjeglicama koje osjećaju osnovan strah od proganjanja zbog pripadnosti određenoj rasi, naciji, vjeri, pripadnosti određenoj društvenoj skupini ili zbog političkog mišljenja. Pravo na azil imaju svi oni koji uspiju dokazati taj strah od proganjanja. Tražitelji/ice azila su: maloljetni i punoljetni muškarci i žene, obrazovane osobe, socijalno ugrožene osobe, žrtve trgovanjem ljudima i dr.

Pored tražitelja/ica azila, grupa stranaca koja često boravi u Hrvatskoj su tzv. nezakoniti/neregularni migranti/ice, osobe koje se zateknu na granici ili teritoriju Republike Hrvatske bez valjanih dokumenata. Upravo zato se nazivaju neregularnim migrantima/icama i obično se nalaze u centru zatvorenog tipa, Prihvatnom centru za strance u Ježevu, nedaleko Zagreba. Veliki broj nezakonitih migranata/ica postanu i tražitelji/ice azila.

U Republici Hrvatskoj pitanjem i politikom azila bave se nadležne institucije (Ministarstvo unutarnjih poslova, Ured za ljudska prava), neke nevladine organizacije (Centar za mirovne studije, Hrvatski pravni centar, Hrvatski crveni križ), međunarodne organizacije (UNHCR, IOM) i dr. U koordinaciji Hrvatskog pravnog centra djeluje i neformalna Koordinacija za azil, čije su članice organizacije i institucije koje se usko bave ovim područjem u svom radu. Sastanci Koordinacije služe za međusobno informiranje i učvršćivanje među-sektorske suradnje. Područje azila u Republici Hrvatskoj regulirano je Zakonom o azilu. Prvi zakon donesen je 2003., a drugi 2008. godine, koji je korigiran Izmjenama i dopunama Zakona o azilu(NN 88/10). Osim azila, zakon regulira i institut supsidijarne zaštite koja je dodijeljena izbjeglicama koje nisu ostvarile pravo na azil.

Od početka našeg rada u ovome području, zamjećujemo kompleksne višeslojne probleme:
- društvena ksenofobija i jačanje predrasuda i stereotipa prema tražiteljima/ica azila i nezakonitim migrantima
- nedovoljno otvorena, odnosno restriktivna azilna politika
- slaba koordinacija nadležnih ministarstava i dr. vladinih tijela u području zaštite ljudskih prava tražitelja/ica azila, azilanata/ica i dr. izbjeglica
- nedovoljno razvijene integracijske politike za azilante i osobe sa supsidijarnom zaštitom (uz manjak suradnje institucija međusobno i suradnje institucija sa nevladinim organizacijama)
- slaba medijska zastupljenost tema koje se tiču tražitelja/ica azila, azilanata/ica, azilne politike i sl.

Još 2004. godine kroz suradnju programa Mirovnih studija i programa Azila inicirali smo akcijsko istraživanje 'Azil u Hrvatskoj'. ujedno i prvo istraživanje o azilu u RH uopće. Istraživanje smo fokusirali na: ispitivanje institucionalnog okvira i njegove kvalitete u području azilne politike, odnos medija i organizacija civilnoga društva prema azilu i djelovanje spram nedostataka azilne politike i ukupnog tretmana tražitelja/ica azila, te na direktan rad s tražiteljima/icama azila gdje je fokus bio na osobne priče (razlozi bijega iz domicilne zemlje, prijeđen put do Hrvatske, očekivanja od života u Hrvatskoj). Istraživanje 'Azil u Hrvatskoj'

Rezultati istraživanja odveli su nas u višegodišnju kampanju 'Hrvatska - (k)raj na zemlji'. Cilj kampanje bio je potaknuti stručnu i javnu diskusiju o pravima tražitelja/ica azila te unaprijediti sveukupnu politiku azila i suradnju nadležnih institucija i organizacija u području razvoja integracijskih politika. Kroz kampanju organizirali smo: prvu međunarodnu konferenciju o integracijskim politika i sustavu azila uopće čije smo preporuke objavili u priručniku za integraciju, namijenjem institucijama, pod nazivom 'Azil u Hrvatskoj - integracijske politike', izložbu 'Azil kao ljudsko pravo' koja je organizirana u Sisku, Slavonskom brodu, Rijeci i Zagrebu, a koju su činili razni umjetnički radovi (od slika, preko fotografija, grafika, skulptura, mozaika, do literarnih radova), 4 okrugla stola o pravima tražitelja/ica azila (Stranac u mom dvorištu, Od t'ge za jug na zahod i dr.) te niz javnih rasprava, medijskih nastupa i sl. Osim toga, direktno smo radili s tražiteljima/icama azila kroz radionice Boalovog teatra i upostavljanje tečaja hrvatskog jezika. Relevantan produkt naše kampanje je i dokumentarni film 'Hrvatska - (k)raj na zemlji', nastao u suradnji s Fade-IN. Od 2005. godine redovito objavljujemo Institucionalni vodič za tražitelje/ice azila ne nekoliko jezika (hrvatski, engleski, francuski, turski, farsi, arapski, albanski, hindu itd.).

Od 2004. godine kontinuirano održavamo tečaj hrvatskoga jezika, a od sredine 2006. godine tečaj se održava redovitom dinamikom od strane angažiranih volontera/ki, uglavnom polaznika/ica Mirovnih studija, članova/ica Centra za mirovne studije i zainteresiranih građana/ki. Prije rada sa tražiteljima/icama azila volonteri/ke prolaze intenzivnu edukaciju, a njihov rad se prati i supervizira. Do sada smo održali oko 1.000 sati hrvatskoga jezika za oko 200 tražitelja/ica azila i azilanata/ica. Osim volontiranja u programu tečaja hrvatskoga jezika, polaznici/e Mirovnih studija i drugi uključuju se u rad na javnim politikama azila ili istraživačkim aktivnostima. Jedna generacija studenata/ica Mirovnih studija organizirala je radionicu Boalovog teatra s tražiteljima/icama azila u Kutini koju je i javno prezentirala u Zagrebu povodom Međunarodnog dana izbjeglica 20.06.2008. godine pod nazivom 'Apel Za Izlaz iz Labirinta'.

Iako se CMS primarno ne bavi socijalnom politikom i socijalnim uslugama, primjećujemo kako je socijalna uključenost tražitelja/ica azila i azilanata/ica neizmjerno slaba te kao važan prioritet u svome radu vidimo razvijanje održive suradnje sa lokalnim (Kutina i okolica, Zagreb) organizacijama i institucijama u pružanju informacija i socijalnih usluga tražiteljima/icama azila i azilantima/icama te otvaranje Prihvatilišta za tražitelje/ice azila za takav oblik rada.

Od dodjele prvog azila u Hrvatskoj radimo na razvijanju integracijskih politika za azilante/ice, osobe koje će svoj život provesti u Hrvatskoj i koje se suočavaju sa iznimno teškim životnim uvjetima kada se to tiče usvajanja hrvatskoga jezika, prilika za zaposlenje, daljnje obrazovanje, smještaj i kvalitetnu zdravstvenu i socijalnu skrb. CMS se uglavnom ovim problemom bavi kroz zagovaranje integracijskih politika prema institucijama te direktnom pomoći azilantima/icama u integraciji i rješavanju svakodnevnih problema.

 

Naš rad do sada su podržali: Nacionalna zaklada za razvoj civilnoga društva, Ured za ljudska prava Vlade RH, Ministarstvo znanosti, obrazovanja i športa, Europska komisija, Veleposlanstvo Kraljevine Nizozemske, European Fund for Balkans i UNHCR Hrvatska.

 

About Asylum programme

Since 2003, in our work we have considered important the subject of human rights and the human rights of foreign citizens, particularly asylum-seekers and irregular immigrants. Since 1997 the number of asylum-seekers in Croatia has increased to reach a total of more than 3,000 persons, 65 of which received the protection of asylum keeper status together with protection offered to their families. The largest number of asylum-seekers in the last four years came from Serbia, Afghanistan, Pakistan, Iran, Bosnia and Herzegovina and Kosovo, followed by Turkey, Hungary and the Russian Federation. Asylum-seekers in Croatia arrive from nearly fifty countries and the list includes the Czech Republic, Slovenia, France, and Italy.

It is noteworthy that in the last four years the number of asylum-seekers has slowly decreased from 2007 when 170 persons requested asylum to 2008, which saw 129 requests, while in 2009 there were 120 requests submitted for asylum. By September of 2010 asylum was requested by 122 persons. Apart from the slightly more than 10 successful asylum applications between 2007 and September 2010, 12 persons received subsidiary protection in either first instance or second instance proceedings .
Asylum is a legal and political protection granted to the refugees who owing to a well- founded fear of being persecuted for reasons of race, nationality, religion or membership of a particular social group or political opinion leave their domestic countries and homes. The asylum is given to all those who can prove well-founded fear of persecution. Asylum seekers are: minors, adult men and women, educated persons, vulnerable people and victims of trafficking etc.
In addition to asylum seekers, there are groups of foreigners who can be ‘caught' in Croatian territory or at the borders while having no valid documents. That is why they are called irregular or mostly used illegal migrants. If got ‘caught' by police they are usually located in a closed-type facility named Reception Centre for foreigners, located near Zagreb. A significant number of irregular migrants become asylum seekers.
In Croatia relevant institutions dealing whit the issue of asylum policy are: Ministry of the Interior, Governmental Office for Human Rights, some NGOs (Centre for Peace Studies, the Croatian Law Centre, the Croatian Red Cross), international organizations (UNHCR, IOM) and others.
The Croatian Law Centre acts as a coordinator of the informal Asylum Coordination, whose members are organizations and institutions which are closely dealing with this field of work. Coordination meetings are used for mutual informing and strengthening inter-sectoral collaboration. Asylum area in the Republic of Croatia is regulated by the Asylum Act. The first law was passed on in 2003, and the other one in 2008. In summer 2010 the Croatian Parliament accepted Amendment Asylum Act
In addition to asylum, the Asylum Act also regulates the institute of subsidiary protection, which is assigned to more refugees who are not eligible for granting asylum.
Since the beginning of our work in this field, we perceive complex multilayer problems:
- Xenophobia and strengthening of social prejudices and stereotypes towards asylum seekers and irregular migrants,
- Insufficiently open or restrictive Asylum Policy,
- Weak coordination of the competent ministries and the other governmental bodies in the field of human rights of asylum seekers, asylum grantees, and other refugees,
- Under-developed integration policy for asylum grantees and persons with subsidiary protection (the lack of institutional cooperation and mutual cooperation of institutions with non-governmental organizations),
- Weak media representation of asylum seekers, asylum grantees, asylum policy issues etc.

In 2004 through co-operation between the programmes Peace Studies and Asylum we carried out the research project ‘Asylum in Croatia'. The results of the research led us to the campaign ‘Croatia - E(de)nd on Earth', which lasted several years, and had the purpose of encouraging expert and public discussion about the rights of asylum-seekers, improvement of general asylum policy, and co-operation between relevant institutions and organisations in the field of development of integration policies. As part of the campaign we organized: an international conference about integration policies and the asylum system, the recommendations of which we published in an integration handbook ‘Asylum in Croatia: Integration Policies', the exhibition ‘Asylum as a Human Right' which was displayed at Sisak, Slavonski Brod, Rijeka, and Zagreb, several round-table discussions about the rights of asylum-seekers (Stranger in My Yard, From Southern Sadness to Going West, and others), and a series of public discussions, media appearances and so on. As well as this we worked directly with asylum-seekers through the Boal theatre workshops and organizing courses teaching the Croatian language. A relevant product of our campaign was a documentary film ‘Croatia - E(de)nd on Earth' made with the co-operation of the organization Fade-IN. Since 2005 we have regularly published the Guide to Croatian Institutions for Asylum-Seekers in several languages (Croatian, English, French, Turkish, Farsi, Arabic, Albanian, Hindu etc.).

Since 2004 we have continually organized a course teaching the Croatian language; since mid-2006, in agreement with the Ministry of Interior Affairs, the course has been regularly held by engaged volunteers, mostly attendees of Peace Studies, members of the Centre for Peace Studies, and interested citizens. Before working with asylum-seekers the volunteers go through intensive training and their work is monitored and supervised. To date we have held around 1,000 hours of Croatian language tuition for around 200 asylum-seekers and asylees. Aside from volunteering in the Croatian language course, the attendees of Peace Studies and others join in the work on public asylum policy or research activities. One generation of Peace Studies students organized a Boal theatre workshop with the asylum-seekers at Kutina, which was presented publicly in Zagreb on the occasion of International Refugee Day on 20 June 2008, and was entitled ‘Appeal for a Thread out of the Labyrinth'.

Although CPS does not primarily deal with social policy and social services, we note that the social involvement of asylum-seekers and asylees in wider social, economic and cultural spheres is remarkably weak, and we see, as an important priority in our work, the development of sustainable co-operation with local (Kutina and surrounding areas, Zagreb) organizations and institutions in providing information and social services to asylum-seekers and asylees, and the opening of a Centre for asylum-seekers which would help fulfil this agenda.

Since the first successful asylum application in Croatia we have been working on the development of integration policies for asylees, persons who will spend their lives in Croatia and who are faced with extremely difficult life-conditions in terms of the adoption of the Croatian language, employment opportunities, further education, accommodation and good-quality health and social care. CPS mostly deals with this problem through the advocacy of integration policies to relevant institutions and direct help for asylees in terms of integration and everyday problem-solving.

À propos du programme d'asile


Á partir de 2003, nous avons considéré important le sujet des droits de l'homme et du citoyen étranger, notamment concernant les demandeurs d'asile et les immigrés irréguliers. Depuis 1997, le nombre de demandeurs d'asile en Croatie a augmenté pour atteindre un total de plus de 3000 personnes. Selon les statistiques officielles du Ministère de l'Intérieur, depuis 2007 jusqu'en Septembre 2010 ,541 personnes ont demandé l'asile en Croatie, dont 65 ont bénéficié de la protection du statut de demandeur d'asile ainsi que leur famille. La majorité des demandeurs d'asile de ces quatre dernières années viennent de Serbie, d'Afghanistan, du Pakistan, d'Iran, de Bosnie-Herzégovine et du Kosovo, et dans une moindre mesure de Turquie, de Hongrie et de Russie. Les demandeurs d'asile en Croatie arrivent d'une cinquantaine de pays et la liste inclut aussi la République tchèque, la Slovénie, la France et l'Italie.
On a remarqué qu'au cours des quatre dernières années, le nombre de demandeurs d'asile a progressivement diminué de 170 personnes en 2007, à 129 en 2008, 120 durant 2009, et jusqu'à septembre 2010, on a enregistré 122 demandes d'asile. Mis à part le faible nombre de réussites des demandes d'asile, au total 10 demandes entre 2007 et Septembre 2010, 12 personnes ont reçu la protection subsidiaire, durant les procédures de première ou de deuxième instance.
L'asile est une protection juridique et politique accordée aux réfugiés à cause d'une crainte bien fondée d'être persécuté pour des raisons liées a la race, la nationalité, la couleur, la religion, l'appartenance à un certain groupe politique ou autre opinion politique. Le droit d'asile est accordé à tous ceux qui peuvent prouver une crainte bien fondée de persécution. Les demandeurs d'asile sont : des mineurs, des adultes hommes et femmes, des personnes instruites, des personnes vulnérables et victimes de trafic, etc.
En plus des demandeurs d'asile, il y a des groupes d'étrangers qui peuvent être «arrêtés» dans le territoire ou à la frontière croate sans la possession de documents valides, c'est pour cela qu'ils sont appelés immigrés irréguliers ou le plus souvent illégaux ; s'ils se font «arrêter », on peut généralement les trouver dans le centre de détention á côté de Zagreb, un grand nombre d'immigrés illégaux deviennent des demandeurs d'asile.
En Croatie, certaines institutions compétentes font face au problème lié á la politique d'asile dont le Ministère de l'Intérieur, le Bureau des Droits de l'Homme, certaines ONG (le Centre des Etudes pour la paix, le Centre de droit Croate, la Croix-Rouge Croate), les organisations internationales (UNHCR, IOM) et d'autres.
Le Centre de droit Croate dirige la coordination informelle en matière d'asile, dont les membres sont des organisations et des institutions, qui sont étroitement liées dans ce domaine de travail. Des réunions de coordination sont utilisées pour informer mutuellement et renforcer la collaboration intersectorielle. Le secteur d'asile en République de Croatie est réglementé par la loi d'asile, la première loi ayant été votée en 2003, et la deuxième en 2008. En été 2010, le Parlement croate a accepté la modification de la loi sur l'asile.

En plus de l'asile, la loi réglemente également l'Institut de la protection subsidiaire, qui est attribuée aux réfugiés qui ne sont pas admissibles à l'asile.
Depuis le début de notre travail dans ce domaine, nous percevons des problèmes multicouches complexes :
- la xénophobie et le renforcement des préjugés et des stéréotypes envers les demandeurs d'asile et les immigrés illégaux.
- Une politique d'asile insuffisamment ouverte ou restrictive.
- Une mauvaise coordination entre ministères et autres autorités gouvernementales dans le domaine des droits de l'homme, des demandeurs et bénéficiaires d'asile et des autres réfugiés.
- Une politique d'intégration sous-développée pour les demandeurs d'asile et les personnes sous protection subsidiaire (absence d'institutions de coopération et de coopération mutuelle des institutions avec les organisations non gouvernementales).
- Une faible représentation médiatique des problèmes des demandeurs et bénéficiaires d'asile, et de la politique d'asile, etc.
En 2004, grâce à une coopération entre les programmes des études pour la paix et d'asile, nous avons pu lancer le projet de recherche « Asile en Croatie », Les résultats de cette recherche nous ont emmené dans la longue campagne (Croatie fin (in) sur la terre) qui a duré plusieurs années. Le but de cette campagne est d'encourager le débat publique et professionnel sur les droits des demandeurs d'asile et d'améliorer la politique globale d'asile ainsi que la coopération entre les institutions et organisations dans le domaine des politiques d'intégration. Grâce à cette campagne, nous avons pu organiser : la première conférence internationale sur la politique d'intégration et d'asile en général, dont les recommandations ont été publiées dans le manuel d'intégration destiné aux institutions, intitulé «Asile en Croatie - une politique d'intégration», l'exposition «l'asile comme un droit humain», qui a été organisée à Sisak, Slavonski Brod, Rijeka et Zagreb, et qui consistait en plusieurs tables rondes sur les droits des demandeurs d'asile, une variété d'œuvres artistiques (peintures, photographies, estampes, sculptures, mosaïques, et œuvres littéraires), 4 tables rondes sur les droits des demandeurs d'asile (l'étranger dans mon jardin , de la Tristesse du Sud au départ vers l'ouest et autres), une série de débats publics, apparitions dans les médias, etc. En outre, nous avons travaillé directement avec les demandeurs d'asile à travers des ateliers du théâtre Boal et la mise en place de cours de langue croate. Le produit en cause de notre campagne est un film documentaire, « Croatie - (f)in sur terre », développé en collaboration avec Fade-in. Depuis 2005, le guide institutionnel des demandeurs d'asile a été publié en plusieurs langues (croate, anglais, français, turc, persan, arabe, albanais, hindi, etc.)
Depuis 2004, nous avons organisé continuellement des cours de langue Croate et dès la moitié de 2006 et en accord avec le Ministère de l'Intérieur, les cours ont été régulièrement organisés par des volontaires engagés, la plupart des participants des études de paix, des membres du Centre des études de paix, et des citoyens intéressés. Avant de commencer à travailler avec les demandeurs d'asile, les volontaires suivent une formation intensive et leur travail est contrôlé et supervisé. À ce jour, nous avons organisé environ 1.000 heures de cours de langue croate pour environ 200 demandeurs et bénéficiaires d'asile. À part les bénévoles dans les cours de langue croate, les participants des études de paix et d'autres se joignent aux travaux sur la politique public d'asile ou aux activités de recherche. Une génération d'étudiants des études de la Paix ont organisé un atelier théâtre BOAL avec les demandeurs d'asile à Kutina, qui a été présenté au public à Zagreb à l'occasion de la journée mondiale des réfugiés, le 20 Juin 2008, ayant pour titre « Appel Pour une discussion de sortie du Labyrinthe »
Bien que le CEP ne s'occupe principalement que de la politique sociale et des services sociaux, nous notons que l'engagement social des demandeurs et des bénéficiaires d'asile dans le secteur social, économique et culturel, est remarquablement faible ; notre importante priorité est le développement durable de la coopération entre les autorités locales (de Kutina et des régions avoisinantes, Zagreb), les organisations et les institutions, afin de fournir des informations et des services sociaux aux demandeurs et bénéficiaires d'asile, avec l'ouverture d'un Centre pour demandeurs d'asile qui va contribuer à répondre à ce programme.
Depuis le succès de la première demande d'asile en Croatie, nous avons travaillé sur le développement des politiques d'intégration pour les bénéficiaires d'asile, les personnes qui veulent passer leur vie en Croatie et qui sont confrontées à des conditions extrêmement difficiles en terme d'adoption de la langue croate, de possibilités d'emploi et de continuation d'éducation, de logement et d'accès à de meilleurs services sanitaires et sociaux. Le CEP traite de ce problème, principalement à travers la promotion des politiques d'intégration aux institutions pertinentes et l'aide directe aux bénéficiaires d'asile en ce qui concerne l'intégration et la résolution des problèmes quotidiens.
Jusqu'à présent, notre travail a été soutenu financièrement par : la Fondation nationale pour le développement de la société civile, Le Bureau des Droits de l'Homme du Gouvernement de la République de Croatie, le Ministère de la Science, de l'Education et du Sport, la Commission Européenne, l'Ambassade du Royaume des Pays-Bas, et le Fond Européen pour les Pays des Balkans.
